Case initiated by All Ennore Fishing Village Coalition’s Ravimaran notches major victory.
Justice Jothimani and Technical Member P.S. Rao of the National Green Tribunal have come down heavily on the lack of progress by TANGEDCO in removing flyash dumped over more than 300 acres of the Ennore Creek.
The bench also directed the TNPCB and TANGEDCO to:
1) Remove all the flyash within one week. If TANGEDCO fails to do this, both units of TANGEDCO will be ordered to shut down at the next hearing.
2. Plug all leaks from the flyash pipes with immediate effect.
3. Submit a plan to replace all old pipes.
4. Prosecute errant TANGEDCO officials under Air and Water (Prevention and Control of) Pollution Acts.
The Court has appointed Advocate Lakshmi Narasimhan to oversee the removal of flyash.
The NGT also ordered that a Committee must be set up to assess the impacts to creek, mangroves, Buckingham Canal, and other vegetation and fauna, and that this Committee must include environmental experts, soil specialists, hydrology experts.
